Terms and Conditions for Photory AI

1. Agreement

Welcome to PhotoryAI. By accessing or using our website, mobile or desktop apps, or related services (“Services”), you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use PhotoryAI.

2. Eligibility & Accounts

• You must be at least 16 years old to create an account.
• Provide accurate registration information and keep your password secure. You are responsible for activity under your account.
• We may suspend or terminate accounts that violate these Terms or compromise other users’ safety.

3. Your content & license

You own the photos, audio, and other materials you upload (“User Content”). You grant PhotoryAI a worldwide, non-exclusive, royalty-free license to process User Content solely to provide and improve the Services. This license ends when you delete your content or account, except where retention is required by law or to resolve disputes.

4. Acceptable use

• Only upload media you have permission to use. Respect privacy and publicity rights of the people featured in your photos.
• Do not submit content that is illegal, abusive, hateful, or infringes on intellectual property.
• Do not attempt to interfere with or reverse-engineer our systems, nor use automated tools that burden the Service.

5. Plans, billing & refunds

Paid plans and one-time credits are billed through trusted payment processors. Fees are non-refundable except where required by law or stated in a specific promotion. Subscriptions automatically renew unless canceled in your dashboard before the renewal date.

6. AI output & disclaimers

PhotoryAI generates cinematic effects using machine learning. We aim for consistent results, but outcomes may vary based on your uploads. The Service is provided “as is” without warranties of any kind, including fitness for a particular purpose or non-infringement.

7. Limitation of liability

To the maximum extent permitted by law, PhotoryAI and its suppliers are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amounts you paid to PhotoryAI in the 12 months preceding the claim.

8. Termination

You may stop using PhotoryAI at any time. We may suspend or terminate the Service or your access if we believe you have violated these Terms or create risk for other users. Upon termination, your right to use the Service ends, but certain sections (including Sections 3, 6, 7, 9, and 10) survive.

9. Governing law

These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law principles. Disputes will be resolved in the state or federal courts located in San Francisco County, California, unless otherwise required by local law.

10. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of PhotoryAI after changes take effect constitutes acceptance.
